IREPOR- .~o the Honorable Mayorand City Council <br />T <br /> From the City Manager <br /> <br /> March 25, 2002 <br /> <br /> Subject <br /> Senate Bill 1870 - Bay Area Water Reliability Financing Authority Act <br /> <br /> Recommendation <br />By resolution, support state legislation (SB 1870) to enable local public entities in Alameda, <br />San Mateo and Santa Clara counties that rely on the San Francisco Public Utilities <br />Commission (SFPUC) regional water system, acting collectively, to secure funds to repair <br />the system. Such funds could be made available to SFPUC on mutually agreeable terms if <br />the SFPUC does not successfully secure funding for and begin construction of the most <br />critical seismic-safety improvement projects. <br /> <br />Background <br />On February 22, 2002, Senator Speier submitted SB 1870 to the state legislature. See <br />attached Fact Sheet for Senate Bill 1870. The bill has been assigned to the Senate <br />Committee on Local Government and the Senate Committee on Agriculture. No dates for <br />hearings have been set for this bill. Testimony and expressions of support from Bay Area <br />Water Users Association (BAWUA) member agencies is essential before the hearings <br />begin. The Committee for Regional Water Reliability, chaired by Councilmember Ruskin, <br />will be coordinating the advocacy effort with the BAWUA staff, and representing the <br />interests of all BAWUA members. <br /> <br />Alternative <br />Do not support SB 1870. <br /> <br />Fiscal Impact <br />No direct fiscal impact to Redwood City would occur should the City. Council pass this <br />resolution. The Settlement Agreement and Master Water Sales Contract between the City <br />and County of San Francisco and certain Surburban Purchasers effective May 25, 1984 <br />delineates the financial terms and conditions in which the SFPUC recovers approximately <br />2/3 of all capitalized system improvements costs via the wholesale water rates paid by <br />BAWUA agencies.
