<br />A2reement <br /> <br />WHEREFORE, for valuable consideration, including their mutual <br />promises set forth below, the Adult Bookstore, David Stunnan, and the City (collectively <br />the ''parties'') agree as follows: <br /> <br />, <br />1. Continued Operation of Adult Bookstore. Notwithstanding <br />Article 27, the parties agree that th~ Adult Bookstore may continue to operate at <br />739 EI Camino Real, Redwood City, California, for the term of years set forth in <br />section 2 below, provided that the Adult Bookstore complies with all other applicable <br /> <br />laws and this Agreement, including the following additional conditions: <br /> <br />(a) Hours of Operation. The Adult Bookstore shall be open <br />for business only between the hours of 8:00 a.m. and 12:00 midnight on any given day. <br />(b) No expansion of business. The Adult Bookstore currently <br />consists of a bookstore, retail sales of adult novelties and videos, and a video arcade. The <br /> <br />Adult Bookstore shall neither expand its facilities nor increase its current uses. Further, <br />the Adult Bookstore shall not have any live entertainment of any kind, including, but not <br /> <br />limited to, nude or semi-nude entertainment, live peep shows or other live adult <br /> <br />entertainment. <br /> <br />(c) Age Limit. In recognition of the fact that the Adult <br />Bookstore is located near a high school that serves, through certain programs, students up <br />to the age of twenty-one, the Adult Bookstore agrees not to serve any person under the <br /> <br />age of 21 and to prohibit any person under the age of 21 from entering the premises. <br />(d) Front Exterior Improvements. The Adult Bookstore agrees <br /> <br />to remodel the front exterior of the premises in a manner that meets the requirements set <br /> <br />forth in Exhibit A, attached hereto and that is approved by the City (the "Remodeling <br />Project"). The Adult Bookstore shall hire a licensed architect to submit plans to and <br />work with the City during the pennit and inspection process for the Remodeling Project. <br />The Adult Bookstore shall apply for an architectural permit no later than 60 days after the <br /> <br />2 <br />
