This amendment is not intended to limit, or <br />give the FCC the authority to limit, tocal authority to require cable operators <br />provide additional Information or guarantees with respect to a cable sale or <br />transfer. .. <br /> <br />Section 18 of Conference Report for the 1992 Cable Act dealing with Section 626 ("Renewal") <br />also addresses transfer considerations: <br /> <br />"The conferees have deleted sections 11(c) and 11(d)(2) of the Senate bill <br />which provide that a franchising authority has the right to consider the quality of <br />service provided by the cable operator throughout the franchise term. The <br />conferees believe that franchising authorities have the duty and authority now to <br />consider the quality of the cable operator's service throughout the franchise <br />term. This provision was removed out of concern that it would be applied where <br />a new cable operator acquires a franchise from the operator who initially <br />entered into the franchise agreement during the pendency of the franchise <br />period. As the franchisino authoritv has the power to aporove such a transfer. it <br />should address any deficiencies in the service of the oriainal franchisee at the <br />tirpe of the transfer."
