(d) flow of water through the creek in its present condition continues to <br /> impede creek flow and will further erode the creek bed and endanger the <br /> health and safety of residents, and private and public property in the <br /> coming wet-weather season; <br /> <br />(e) said California Department of Fish and Game permit requires that the <br /> work to removal of dirt and debris shall be substantially complete by <br /> October 15, 1998; <br /> <br />(t') the emergency created by the time restriction imposed by said permit will <br /> not allow a delay resulting from the competitive advertisement or <br /> solicitation for bids, and the action hereinafter authorized is necessary to <br /> respond to the emergency; <br /> <br />(g) the public interest and necessity demand the immediate expenditure of <br /> <br /> public monies to safeguard life, health and property in order to alleviate <br /> the emergency condition described hereinabove. <br /> 2. Emerl:lenc¥ Authorization. The City Manager is hereby authorized <br /> <br />and directed to enter into and execute a contract and/or other documents (all in <br />form approved by the City Attorney) with $.G.
