<br />DES:sn 2/17/87 <br /> <br />(#19) <br /> <br />district upon receipt by the district of a resolution of the <br /> <br />council of the city requesting exclusion; and <br /> <br />WHEREAS, this Council desires to exclude the Excluded <br /> <br /> <br />Territory from the District; and <br /> <br />WHEREAS, the parties to the Transmission Agreement desire to <br /> <br /> <br />enclude the Excluded Terri tory from the service area of the <br /> <br /> <br />Transmission Agreement; and <br /> <br />WHEREAS, paragraph XI of the Transmission Agreement provides <br /> <br /> <br />that the parties thereto may revise, alter, amend or supplement <br /> <br /> <br />said agreement in writing; and <br /> <br />WHEREAS, the parties to the Capacity Agreement desire to <br /> <br /> <br />confirm that sanitary sewerage treatment capacity rights <br /> <br />allocated thereunder for the Excluded Territory shall be <br /> <br /> <br />reallocated to the treatment capacity rights of the City of <br /> <br /> <br />Redwood City; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br /> <br />AS FOLLOWS: <br /> <br /> <br />1. Request is hereby made for the exclusion of the Excluded <br /> <br />Territory from the Emerald Lake Heights Sewer Maintenance <br /> <br />District of the County of San Mateo; provided that the agreement <br /> <br /> <br />hereinafter referenced shall be executed by all parties thereto. <br /> <br />2. This Council hereby finds and determines that sanitary <br /> <br /> <br />sewerage treatment capacity rights allocated under the Capacity <br /> <br /> <br />Agreement in the amount of one (1) dwelling unit equivalent (250 <br /> <br /> <br />gallons per day wastewater volume) for the benefit of lands <br /> <br />within the Emerald Lake Heights Sewer Maintenance District shall, <br /> <br />2 <br /> <br />1 0433 <br />
