J <br />J I, JI,.. <br />NQV 1 0 198e <br /> <br />RESOLUTION APPROVING AN AMENDMENT PROPOSED BY OWNERS OF <br />LOTS 1, 2, 3 AND 4 OF CORDILLERAS HEIGHTS, UNIT NO. 4 <br />TO "19 FT. PRIVATE INGRESS/EGRESS EASEMENT MAINTENANCE <br />AGREEMENT"; AND APPROVING NAUTILUS INSURANCE COMPANY <br />POLICY NO. L13915 AS ENDORSED AS A CITY GRANTED <br />LIABILITY INSURANCE COVERAGE EXCEPTION ALLOWED UNDER <br />THE LOT OWNERS' PROPOSED AMENDMENT TO THE SAID <br />MAINTENANCE AGREEMENT <br /> <br />WHEREAS, by Resolution No. 9598, adopted June 11, 1984, this <br /> <br />Council approved and authorized execution of agreement entitled, <br /> <br />"Agreement for the Improvements of Cordilleras Heights Unit No. 4 <br /> <br />Subdivision" ("Improvement Agreement"); and <br /> <br />WHEREAS, the Lot Owners of Lots 1 through 4 of Cordilleras <br /> <br />Heights Unit No. 4 ("Lot Owners") executed the Improvement <br /> <br />Agreement and thereby agreed to construct a road on a 19 ft. <br /> <br />ingress/egress easement ("Easement") extending from Upland Court; <br /> <br />and <br /> <br />WHEREAS, the Lot Owners are responsible for the maintenance <br /> <br />of the Easement under an agreement entitled, "19 Ft. Private <br /> <br />IngreSS/Egress Easement Maintenance Agreement" <br /> <br />( "Maintenance <br /> <br />Agreement"); and <br /> <br />WHEREAS, among other requirements, the Maintenance Agreement <br /> <br />requires the Lot Owners to purchase liability insurance insuring <br /> <br />themselves against liability arising from the use and/or their <br /> <br />ownership of the Easement; and <br /> <br />WHEREAS, Lot Owners have had great difficulty in obtaining <br /> <br />the liability insurance required under the Maintenance Agreement <br /> <br />and therefore propose to amend Section 2, Liability Insurance of <br /> <br />the Maintenance Agreement; and <br /> <br />10375 <br />
