Level 3's insurance, to require its contractor(s) to procure and maintain, at its (or its contractors') <br />sole cost and expense (and to prove to City's reasonable satisfaction that it remains in effect <br />throughout the work), the kinds of insurance described below: <br /> <br /> (1) Workers' Compensation and Employers' Liability Insurance. Level 3 shall <br />secure the payment of Workers' Compensation in accordance with the provisions of Section <br />3700 of the California Labor Code (and any amendments thereto or successor acts or statutes) <br />and Level 3 shall furnish City with a certificate evidencing such coverage together with a <br />verification thereon as follows: <br /> <br /> "1 am aware of the provisions of Section 3700 of the California Labor <br /> Code which requires every employer to be insured against a liability for workers' <br /> compensation or to undertake self-insurance in accordance with the provision of <br /> that Code, and I will comply with such provisions before commencing the <br /> performance of work under this Agreement." <br /> <br /> Level 3 shall also maintain Employer's Liability coverage with minimum limits of <br />$2,000,000. <br /> <br /> Whether FELA or Workers' Compensation applies, Level 3 shall furnish the City with the <br />Certificate(s) of Insurance required hereunder prior to the commencement of work. The <br />Certificate shall also provide that Level 3's policy will not be canceled or have coverage reduced <br />without thirty (30) days prior written notice. <br /> <br /> (2) Commercial General Liability Insurance. <br /> <br /> (a) Level 3 shall, at its own cost and expense, also procure and maintain <br /> <br /> Commercial General Liability insurance which shall include as additional insureds the <br /> City of Redwood City, its Council members, officers, employees, and agents while acting <br /> in such capacity, and their successors or assignees, as they now, or as they may <br /> hereafter be constituted, singly, jointly, or severally. <br /> <br /> (b) Insurance shall provide bodily injury and property damage coverage with a <br /> combined single limit of at least $2,000,000 each occurrence or claim and a general <br /> <br />F:Atty/Agr.076 1§ <br />100702 <br /> <br /> <br />
