City, including the Federal Communications Commission and the State of California Public <br />Utilities Commission. <br /> <br /> "Agreement" means this "AGREEMENT BETWEEN THE CITY OF REDWOOD CITY <br />AND LEVEL 3 COMMUNICATIONS, LLC FOR THE CONSTRUCTION, INSTALLATION, AND <br />MAINTENANCE OF FIBER OPTIC CABLES AND RELATED FACILITIES WITHIN THE PUBLIC <br />RIGHT-OF-WAY." <br /> <br /> "Level 3" means LEVEL 3 COMMUNICATIONS, LLC, a Delaware limited liability <br />company, and its lawful successors or assigns. <br /> <br /> "Business Day" means any calendar day, except a Saturday, Sunday, and any Day <br />observed as a legal holiday by City. For the purposes hereof, if the time in which an act is to be <br />performed falls on a Saturday, Sunday, or any Day observed as an official holiday by City, the <br />time for performance shall be extended to the following Business Day. <br /> <br /> "City" means the City of Redwood City, a charter city and municipal corporation of the <br />State of California. <br /> <br /> "City Manager'' means the individual designated as the City Manager under Section 26 of <br />the Charter of the City of Redwood City or his/her designee. <br /> <br /> "Council" means those elected officials which are authorized to exercise the powers <br />granted to and vested in City under Government Code Section 37100, et seq., and the Charter <br />of the City of Redwood City. <br /> <br /> "Day" means any calendar day, unless a Business Day is specified. For the purposes <br />hereof, the time in which an act is to be performed shall be computed by excluding the first Day <br />and including the last. <br /> <br /> "Director" means the Director of Community Development or his/her designee. <br /> <br /> "Fee" means any assessment, license, charge, fee, imposition, tax (but excluding the <br />telephone users tax), or levy lawfully imposed by any governmental body. <br /> <br />F:Atty/Agr.076 2 <br />100702 <br /> <br /> <br />
