SECTION 7 TRAINING If training is included in this Agreement, Customer agrees to notify Motorola immediately ifa date change for a scheduled training program is required. A charge will · apply to a training program rescheduled by-Customer less than thirty (30) days prior to its scheduled start date. SECTION 8 SYSTEM ACCEPTANCE A. Motorola will test the Communications System in accordance with the Acceptance Test Plan, as supplemented by any changes to the test plans or procedures as set forth in the approved Detailed Design Document. System acceptance will occur upon the successful completion of such testing and the successful completion of the 30 Day Burn In Period (described below) ("System Acceptance") at which time both parties shall promptly execute a certificate of system acceptance. If the Acceptance Test Plan includes separate tests for individual subsystems, both parties shall promptly execute certificates of subsystem acceptance upon the successful completion of testing of such subsystems. Minor omissions or variances in performance which do not materially affect the operation of the Communications System as a whole, referred to as "punch list items," will not postpone System Acceptance. Before the commencement of the ten (10) day audio test to be performed by Customer as described in Section 8.B below, Customer and Motorola will jointly prepare the punch list of such omissions and variances which Motorola will correct according to an agreed upon schedule. B. Within five (5) days of successful completion of the Coverage Acceptance Test, Customer will perform a ten (10) day audio test to verify the audio quali~y of the tmnked and mutual aid radio systems. Motorola shall have no responsibility concerning this ten (10) day audio quality test, although Motorola shall have the right to participate in it. This test will be limited to twenty (20) subscriber radio units. After Customer completes this ten (10) day audio test, it may choose one of three options: (1) execute a Change Order to have performed the Delivered Audio Quality (DAQ) test for the tmnked and/or mutual aid radio systems as described in Exhibit B at an additional price of up to $200,000, payable upon successful completion of the DAQ test; (2) define areas of concern resulting from the ten (10) day audio test and execute a Change Order for Motorola to address these concerns on a time and materials basis during the next sixty (60) days; or (3) take no further action as a result of the ten (10) day audio test. Successful completion of the Acceptance Test Plan will occur when the ten (10) day audio test is completed,, unless Customer elects option 1 to have the DAQ performed, in which case successful completion of the Acceptance Test Plan will occur when the DAQ is successfully completed. C. The 30 Day Bum In Period shall commence immediately after the successful completion of the Acceptance Test Plan but before the loading of the System begins.
