<br />6.1A <br />Page 2 <br /> <br />2. Payment by Tarboosh to Redwood City of $500 monthly, with CPI adjustments <br />every fifth year; plus 6 month upfront deposit of $3,000. <br />3, Tarboosh will power wash entire plaza and dining areas (Area 1 in Exhibit C of <br />Agreement) on a quarterly basis, <br />4. In addition to plaza and dining areas, Tarboosh shall keep surrounding <br />landscaped portions of The Paseo (Area 2 on Exhibit D of Agreement) free from <br />all garbage, refuse and recyclables on a daily basis, <br />5. Tarboosh shall comply with all conditions of any entitlements and permits. <br />Failure to do so shall constitute a material breach of the License Agreement. <br />The use of the space may not commence until a new Planning Use Permit is <br />obtained (expected by the end of the week of January 22nd), although the <br />monthly fee commences upon issuance of the Notice to Proceed with <br />improvements, Issues to be resolved with the new Use Permit include outside <br />storage, delivery area, hours of operation, and clearance requirements for <br />current sidewalk cafe area, <br />6. Permanent improvements to the dining area require a construction permit. Costs <br />for removing all permanent improvements will be covered by a bond, City <br />reserves the right to have permanent improvements become part of the property, <br /> <br />Fiscal Impact <br />Tarboosh will provide $3,000 in advance user fees as noted, and be responsible for a <br />$500/month license payment or $6,000 per year. In addition, they shall power wash the <br />patio/plaza area quarterly, which is an estimated annual cost of $3,200 to $4,400. <br />Thus, their total annual contribution will range from $9,200 to $10,400, The advance <br />user fees may be used for license payments due should Tarboosh vacate the premises <br />prior to the expiration of the license term. <br /> <br />The total annual estimated maintenance cost for the entire Paseo area (excluding the <br />power washing for the patio/plaza area) ranges from a low of $11,405 to a high of <br />$18,208, The City will be responsible for those maintenance costs.
