<br />6.1A <br />Page 4 <br /> <br />2.1 The term of this License shall commence upon the issuance of the Notice to <br /> <br />Proceed issued by the Redevelopment Division of the Community Services Department (the "License <br /> <br />Commencement Date") and shall continue for one year thereafter to 12:00 am ('Termination Date"), <br /> <br />unless sooner terminated as hereinafter provided. The Notice to Proceed shall serve as proof of the <br /> <br />License Commencement Date. Upon the Termination Date, unless this License is renewed pursuant to <br /> <br />paragraph 2.2, this License will continue as a month-ta-month tenancy. Licensor may terminate this <br /> <br />Agreement by giving written notice to Licensee at least thirty (30) days prior to the intended termination <br /> <br />date. Licensee may terminate the Agreement by giving written notice to licensor at least ninety (90) days <br /> <br />prior to the intended termination date, provided that Licensee is not in breach of the terms of this <br /> <br />Agreement. <br /> <br />2.2 Provided Licensee is not in default hereunder, this License shall automatically renew for <br /> <br />an additional one year period with the same terms, covenants and conditions provided herein, except that <br /> <br />upon such renewal for every fifth year (e.g. 5, 10, 15) the Base User Fee due hereunder shall be <br /> <br />reviewed and may be adjusted pursuant to the Consumer Price Index, more specifically the "CPI-U <br /> <br />(SF/SJ/OAK)". 2.3 <br /> <br />On the License Commencement Date, Licensee shall take possession of the <br /> <br />Premises. If Licensee's ability to take possession by the date as set forth in this provision is delayed as a <br /> <br />result of any of the following causes, the date for delivery shall be postponed without penalty to Licensee <br /> <br />for a period of time equivalent to the period caused by such delay: <br /> <br />(a) acts of Licensor, its agents, or employees; <br /> <br />(b) acts of God which Licensee could not reasonably have foreseen or <br /> <br />guarded against; <br />(c) any strikes, boycotts or like obstructive actions by employees or labor <br /> <br />organizations and which are beyond the control of Licensee and which cannot be <br /> <br />reasonably overcome; or <br /> <br />(d) restrictive regulations by the Federal Government which are enforced in <br /> <br />connection with a national emergency. <br /> <br />2.4 <br />A TTY/AGR/2007.002 <br />012407 <br /> <br />Notwithstanding any of the foregoing, the length of this license period is subject <br /> <br />2 <br />
