Locat safety member benefits subject to a maximum of 90% of <br /> the average final compensation witt not be increased beyond that <br /> limit for unused sick ieave credit. <br /> 9.2 Industrial Qisability Leave <br /> Any safety employee as defined b�� the MOU between the City and thp Public <br /> Employees' Retirement System, who has suffered a disahility arising out of and <br /> in the course of his or her employment, as defined by Workers' Compensation <br /> Laws of the State of Catifornia, shatl be entitted to industrial disability leave <br /> while so disabled without toss of salary, for the period of such disability to a <br /> maximurn af one (1) year or unti! the conditicn is permanent and stationary or <br /> until retirement, whichever occurs first. During the period the employee is <br /> paid by the City, the employee shall assign or endorse to the City any benefit <br /> payments received as a resutt of Workers Compensation insurance coverage. <br /> The City reserves the right to withhold payment of any disability benefits until <br /> su�h time as it is determined whether or not the illness or injury is covered by <br /> Workers' Compensation. <br /> A safety emptoyee on industrial disabitity leave shall accrue sick leave and <br /> vacation in accordance with the Workers' Compensation taws of the State af <br /> California. <br /> 19 <br />
