To move the process of developing the new franchises along in 8an Mateo County, PG&E <br /> representatives suggested that we explore having SAMCAT work on model franchises for <br /> the new G-Trans and E-Trans firms. This idea was discussed by the San Marco <br /> City/County Managers Association and the SAMCAT Board of Directors. Both groups <br /> agreed that this would be a good approach as SAMCAT has prior experience in developing <br /> model franchises and it includes all but lwo cities in the county at this point. <br /> <br /> At the same time, it was also felt that many smaller cities in California would not have the <br /> resources to adequately review and negotiate the ~wo "newce" franchises. $o SAMCAT <br /> approached the League of California Cities and suggested that they look into this area as <br /> well. The result is that the League is now meeting with PG&E and developing a model <br /> franchise document itself that will be used as a model. <br /> <br /> In light of our past experience working as a team in San Marco County and getting better <br /> franchise terms as a result, it is recommended that the agenciesin San Marco County take <br /> advantage of both of these opportunities. Namely, we should track and be involved in the <br /> League process as well as amend the existing SAMCAT JPA document so that SAMCAT <br /> can take the League's final product in this area and tailor it to the unique needs of San <br /> Mateo County agencies. <br /> <br />With that in mind, the attached second JPA Amendment of SAMCAT was developed. It <br />adds the duty of negotiating for model franchises with public utilities (such as PC&E) to <br />SAMCAT's list of potential duties. Once adopted by 2/3 of the SAMCAT member <br />agencies, the SAMCAT Board will then be in position to work on the draft franchise <br />documents for the "newcos" that have been prepared by PG&E as well as any materials <br />developed in this area by the League of California Cities. As always, the consideration and <br />approval of any such franchises will be done by each City Council and by the Board of <br />Supervisors in the case of San Mateo County. <br /> <br />Alternative' <br />Council may elect not to authorize the amendment to the SAMCAT JPA. <br /> <br />Fiscal Impact <br />There is no fiscal impact to the City's budget. This action simply gives authority to the <br />SAMCAT Board to development model franchise agreements for the two new PG&E <br />companies. <br /> <br /> I~lagda A.
