Such information shall be made available dudng regular office hours in <br /> accordance with the City's rules and procedures for making public records <br /> available and a~er payment of reasonable costs, where applicable. <br /> <br /> Information which shall be made available to employee organizations includes <br /> regularly published data covering subjects under discussion. Data collected on <br /> a promise to keep its source confidential may be made available in statistical <br /> summaries, but shall not be made available in such form as to disclose the <br /> source. <br /> <br /> Nothing in this rule shall be construed to require disclosure of records that are: <br /> <br /> 1. Personnel, medical and similar files, the disclosure of which <br /> constitute an unwarranted invasion of personal privacy or which are <br /> contrary to merit system principles; <br /> <br /> 2. Working papers or memoranda which are not retained in the <br /> ordinary course of business or any records where the public interest <br /> served by not making the records available clearly outweighs the <br /> public interest served by disclosure of the records; <br /> <br /> 3. Records pertaining to pending litigations to which the City is a <br /> party, or to claims or appeals which have not been settled; or <br /> <br /> Requiring the City to do research for an inquirer or to do <br /> programming or assemble data in a manner other than that usually <br /> done by the agency. <br /> <br /> SECTION 4 - Cl'TY RZGHTS <br /> <br />To insure that the City is able to carry out its constitutional, chartered and statutory <br />functions and responsibilities, nothing contained herein shall be construed to require the <br />City to meet and confer on matters which are solely a function of management, <br />including the right to direct the work force; to select and determine the number and <br />types of employees required; to determine the content of job classifications; to hire, <br />transfer, promote, suspend, discipline and discharge employees; to assign work to <br />employees in accordance with the requirements determined by the City; to establish and <br />change work schedules and assignments; to lay off employees for lack of work; to <br />expand or diminish services; to subcontract any work or operations; to determine and <br />change methods of operations; to determine and change work locations and the <br />processes and materials to be employed; to take all necessary actions to perform its <br />functions in emergencies. <br /> <br /> 8 <br /> <br /> <br />
