November 18, 2002

Subject
2001 / 2002 Tree Preservation and Sidewalk Repair Program

Recommendation
By Motion, approve Change Order No. 2 for the 2001 / 2002 Tree Preservation and
Sidewalk Repair Program to Consortium Consolidated Corp of Santa Clara, CA, for the
not-to-exceed amount of $160,000.00.

Background
On June 10, 2002, the City Council approved the contract documents and specifications
and awarded the contract to Consortium Consolidate Corp (CC Corp) in the amount of
$537,143.00. CC Corp has been performing the sidewalk repairs to the contract
specifications and to the satisfaction of staff. The work scheduled for completion through
November, 2002 will amount to $500,000. Staff recommends increasing the contract
through Change Order No. 2 in the amount of $160,000, an increase of 29.8%. Change
Order No. 1 adjusts quantities and amounts in an increase of nineteen cents. The
Contractor is agreeable to increase the quantities of work included in Change Order No. 2
at the existing bid unit prices. The additional work will allow staff to continue work in
reporting area 22, bordered by ConnectiCut to the east, Alameda to the west, Goodwin to
the north and Massachusetts to the south.

The approval of Change Order No. 2 will allow staff to continue to complete sidewalk
repairs within Reporting Area 22 through January, 2003. Approving the change order
compliments the Council's goal of accelerating the sidewalk repair cycle by continuing work
in the neighborhood without re-bidding the project.

The timing of the additional Work will be performed while staff meets their projection to
complete the current 2001 / 2002 project and advertise and commence the 2002 / 2003
Tree Preservation and Sidewalk Repair Program within the current fiscal year.

Alternatives
Alternatives to the change order include:
· Do not approve Change Order No. 2 for work not yet completed and do not
perform additional work. End the current project when the original bid amount is
reached.
· Reduce the amount of Change Order No. 2 - reduce the amount of sidewalk
locations the City will complete in reporting area 22 with this contractor.

01-02 TPSRP change orders
