RESOLUTION NO.2002 -6326 <br />A RESOLUTION OF THE TOWN COUNCIL OF TOWN OF WOODSIDE: <br />(1)APPROVING SEWER SERVICE ALLOCATIONS TO 179 ALBION AVENUE AND <br />239 MIR,,"MONTES ROAD;(2)CONSENTING TO THE ANNEXATION OF THESE <br />PROPERTIES INTO THE TOWN CENTER SEWER ASSESSMENT DISTRICT;AND <br />(3)AUTHORIZING THE TOWN MANAGER TO EXECUTE REVISED AGREEMENTS <br />WITH REDWOOD CITY AND THE FAIR OAKS SEWER MAINTENANCE DISTRICT <br />TO ADD THESE TWO PROPERTIES INTO THE APPROVED SERVICE AREA FOR <br />THE TOWN CENTER ASSESSMENT DISTRICT. <br />WHEREAS,the Woodside Municipal Code provides Sewer Service Allocation <br />Regulations beginning at section 51.120;and <br />WHEREAS,Section 51.126 of the Municipal Code provides the process whereby <br />parcels that lie in "Area III"that have failed septic systems can apply for sewer service <br />allocations;and <br />-WHEREAS,the owners of the parcels at 179 Albion Avenue and 239 Miramontes Road <br />have applied for sewer service allocations under the terms of this section;and <br />WHEREAS,the Town Engineer finds that the septic system for each of these parcels has <br />failed and that each is Contiguous Parcel,as provided in Section 51.122;and <br />\VHEREAS,the allocation of sewer service to these two parcels is consistent with the <br />General Plan and reserved sewer capacity is available;and <br />WHEREAS,the legislative bodies of Redwood City and the Fair Oaks Sewer <br />Maintenance District will need to agree to amend the agreements that both those agencies have <br />with the Town of Woodside pertaining to the Town Center Sewer Assessment District in order to <br />allow these properties to be annexed into the District and the Town will need to'execute amended <br />agreements accordingly. <br />NOW THEREFORE,IT IS HEREBY RESOLVED BY THE TOWN COUNCIL <br />OF THE TOWN OF WOODSIDE that: <br />1.Sewer service allocations are approved for the properties at 179 Albion Avenue and 239 <br />Miramontes Road; <br />2.The Town consents to the annexation of these two properties into the Town Center Sewer <br />Assessment District;and <br />3.The Town Manager is authorized to execute amendments to the agreements with <br />Redwood City and the Fair Oaks Sewer Maintenance District to allow the boundaries of <br />the sewer area of the Town Center Assessment District to be revised to allow the two <br />properties to be connected to the Town Center Sewer Assessment District System. <br />I, <br />I <br />I <br />I <br />I <br />*** * * * ******
