exxzszT a <br /> RESOLUTION NO. 2013 - 6934 <br /> RESOLUTZON OF THE TOWN COUNCIL OF THE TOWN OF WOODSIDE: <br /> (1) CONSENTING TO THE ANNEXATION OF 135 DEAN ROAD (PROPERT7C) INTO THE <br /> T000f1 CENTER SEATER ASSESS2�NT DISTRICT; (2) AUTAOR22ING TEE TOWN <br /> MANAGLR TO EXECIITE RE�7ISED AGREEMENTS WITX REDWOOD CITY AND THE FAIR <br /> OA1CS SLSiER MAINTENANCE DISTRSCT (FOSNID) TO ADD THIS PROPERTY INTO TFiE <br /> APPROVED SERVIGE AREI� FOR THE T047N CENTER SE47ER A3SESSMENT DISTR3CT <br /> (gCAD} BND TO REMOVE TE]E HROPERTY FROM THE REDWOOD CREEX TRUNPC SEWER <br /> ASSESSMENT DISTRZCT. <br /> W�REAS, Section 51.123 of the Municipal Code has identified the <br /> Property within Sewer Service Allocation Area II; and <br /> WHEREAS, the Town Engineer finds that the septic system for the <br /> Property has failed as provided in Section 51.122; and <br /> SdE�EREA3, 5ection 51.125(C) of the Municipal Code requires parcels <br /> that 1ie in "Area II" that tiave failed septic systems to connect to <br /> the public sewer system; and <br /> WHEREAS, the owners of the Property have indicated connection to <br /> sewer within the Redwood Creek Sewer Assessment District cannot be <br /> completed; and <br /> W�REAS, the owners of the Property have applied for a sewer <br /> connection to TCAD; and <br /> 9�RFnG, the connection to TCAD sewer facilities is consistent <br /> with the General Plan and reserved sewer capacity in the TCAD is <br /> available; and . <br /> pHEREAS, the Ieqislative bodies of Redwood City and the Fair �aks <br /> Sewer Maintenance District will need to aqree to amend the agreements <br /> that both those agencies have with the Town of Woodside pertaining to <br /> the Town Center Sewer Assessment District in order to allow this <br /> property to be annexed into the District and the Town will need to <br /> execute amended agreements accordingly. <br /> NOW THEREFORE, IT IS HEREBY RESQLVED BY THE TOWN COUNCIL OF THE <br /> TOWN OE WOODSIDE THAT: <br /> 1. The Town Council consents to the annexation af 135 Dean Road <br /> into the Town Center Sewer Assessment District; and <br /> 2. The Town Manager is authorized to execute amendments to the <br /> agreement with Redwood City and the Fair Oaks Sewer <br /> Maintenance Distriet on behalf of the Town to allow the <br /> boundaries of the sewer area of the Town Center Sewer <br /> Assessment District to be revised to allow the pxoperty to be <br /> connected to the Town Center Sewer Assessment District s�stem;, <br /> I hereby ca�kify tha!the ahnve is <br /> pY <br /> ofs������3-�y <br /> Date��.a o�3 <br /> � Tow ' ierk <br /> �7���,c���c:�-r�e. <br /> Page 4 of 5 <br />
