<br />SWC:sh 6/21/85 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9926 <br /> <br />JUL 1 1985 <br />ORIGINAL <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br />ADDENDUM TO AGREEMENT FOR THE IMPROVEMENTS OF PARCEL <br />MAP 85-2 (MID PENINSULA PLAZA) <br /> <br />WHEREAS, pursuant to Resolution No. 9867, adopted April 22, <br /> <br />1985, the City of Redwood City ("City") and Mid Peninsula Plaza <br /> <br />Associates ("Subdivider") entered into an agreement (recorded as <br /> <br />San <br /> <br />Mateo <br /> <br />County <br /> <br />Recorder <br /> <br />No. <br /> <br />85042538) <br /> <br />concerning <br /> <br />the <br /> <br />construction of improvements for Parcel Map 85-2; and <br /> <br />WHEREAS, <br /> <br />pursuant <br /> <br />to paragraph <br /> <br />14 <br /> <br />of <br /> <br />the <br /> <br />aforesaid <br /> <br />agreement, Subdivider has caused to be offered for dedication to <br /> <br />City a deed of easement for right-of-way purposes, from Seventeen <br /> <br />One, Inc., a land holding entity of Lucky Stores, Inc., which <br /> <br />offer of dedication has been consented to by John Hancock Mutual <br /> <br />Life Insurance Company, Mortgagee of said property; and <br /> <br />WHEREAS, said deed of easement contains conditions which <br /> <br />will be unacceptable to City unless Subdivider agrees to assume <br /> <br />responsibili ty for compliance with all conditions contained in <br /> <br />such deed, and to indemnify City for any alleged failure of the <br /> <br />City or Subdivider to comply with said conditions; and <br /> <br />WHEREAS, there has been presented to this Council an <br /> <br />addendum <br /> <br />to <br /> <br />the <br /> <br />aforesaid <br /> <br />improvement <br /> <br />agreement <br /> <br />whereby <br /> <br />Subdivider agrees to accept such added conditions as part of its <br /> <br />obligations under said agreement; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />9 ~2 6 <br />
