A fee interest in and to the Subject Property is <br /> <br />necessary for the public purpose of acquiring, constructing, <br /> <br />operating <br /> <br />and maintaining water <br /> <br />reservoir <br /> <br />facilities <br /> <br />and <br /> <br />appurtenances to serve Redwood City General Improvement District <br /> <br />No. l-64 (the "Proposed Project"). <br /> <br />2. This City is authorized to acquire the Subject Property <br /> <br />by eminent domain pursuant to the provisions of Section 3 of the <br /> <br />Charter of the City of Redwood City, Sections 38730 and 38742(b) <br /> <br />of the Government Code and Sections 50l and 502 of Ordinance No. <br /> <br />1128, as amended (The Redwood City General Improvement District <br /> <br />Ordinance) . <br /> <br />3. This Council hereby declares that it has found and <br /> <br />determined each of the following: <br /> <br />i. The public interest and necessity require the <br />Proposed Project; <br /> <br />ii. The Proposed Project is planned or located in the <br />manner that will be most compatible with the <br />greatest public good and the least private injury; <br /> <br />iii. The Subject Property is necessary for the Proposed <br />Project; and <br /> <br />iv. <br /> <br />The offer required by Section 7267.2 <br />Government Code has been made to the <br />owners of record of the Subject Property. <br /> <br />of <br />owner <br /> <br />the <br />or <br /> <br />4. The City Attorney and/or his designee is hereby <br /> <br />authorized to commence an action <br /> <br />ln eminent domain <br /> <br />for <br /> <br />acquisition of the Subject Property, or otherwise to acquire the <br /> <br />property in accordance with the requirements of law. <br /> <br />2 <br />
