December 2, 2002

Subject
Final Acceptance - Seaport Plaza Subdivision Improvements
Engineering File No. 805-04

Recommendation
Accept the Seaport Plaza Subdivision improvements, following the submission of a
Maintenance Bond in the amount of $160,000.00, in accordance with Paragraph No. 9
of the Agreement, and authorize the release of the bonds.

Background
On November 13, 1998, the City Council approved the Seaport Plaza Subdivision, and
the agreement for the improvements of the subdivision. The main improvements
included grading, street construction, the construction of a sewer system, water and
storm drain system, street lighting and street trees, construction of underground utility
lines. The subdividers, Seaport Plaza Associates, LLC, have completed the
construction of the improvements in accordance with the approved plans, and to the
satisfaction of Engineering and Construction Services.

The subdivider provided a Faithful Performance Bond and a Labor & Materials Bond,
each in the amount of $1,600,000.00, which can now be released.

Alternative
Do not accept the improvements for the Seaport Plaza Subdivision, which would be
contrary to prior Council action.

Fiscal Impacts
The City will assume maintenance responsibility only for the sanitary sewer system, the
water lines and services to the water meters within the easement and the private street
system. Funds for the maintenance cost of these items are appropriated in the Public
Works Services Department Operational budget.

CharlesCsicsman ///'/ ~"~'-Li~d~trand' '-¥ Everett
Supervising Engineer Community Development Services Director City Manager

CC:ss
s/lit)rary/reports/Iowell/accept_Seaport Plaza
