to continue for fiscal years 2000-01 and 2001-02 the same method of determining the <br />amount of the annual contribution; and <br /> <br /> WHEREAS, the JPA Agreement indicates the JPA's intent to continue to support <br />the Fair Oaks Library in recognition that it serves residents of the Fair Oaks <br />unincorporated areas; <br /> <br /> NOW, THEREFORE, IT IS HEREBY AGREED: <br /> <br />1. PAYMENT OF OPERATING COSTS. <br /> <br /> In consideration of the City's continuing to assume responsibility for operation of the <br /> Fair Oaks Library, the Library JPA will contribute funding to the operation of the Fair <br /> Oaks Library, as follows. For the base year of 2001-02, under the terms of the <br /> expiring Agreement, the JPA has paid $142,456. For FY 2002-03 through FY 2004- <br /> 05, the based contribution shall be increased or decreased each fiscal year at the same <br /> percentage rate as the change in the JPA's property tax revenue from the previous <br /> year. Said contributions shall be made from the JPA to the City on a quarterly basis. <br /> <br />2. TERM. <br /> <br /> The term of this Agreement shall commence upon the execution of this Agreement by <br /> all parties and continue in effect through fiscal year 2004-05. <br /> <br />3. TERMINATION. <br /> <br /> This Agreement may be terminated for any reason by either party prior to the end of <br /> its initial term as set forth in paragraph 2 above, with one year written notice to the <br /> other party. However, in the event that the JPA is terminated or the County <br /> withdraws fi-om the JPA prior to the expiration of this Agreement, this Agreement <br /> shall be deemed immediately terminated. <br /> <br /> NOTICES. <br /> <br /> Any notice, demand, request, consent, approval, waiver, or communication tt~at any <br /> party desires or is required to give to another party or any other person shall be in <br /> writing and either served personally or sent by prepaid mail, and if given by mail <br /> shall be deemed sufficiently ~ven when sent by registered or certified mail. Any <br /> notice, demand, request, consent, approval, waiver, or communication that any party <br /> desires or is required to give by mai] to another party shall be addressed to the other <br /> parties at the addresses set forth below. Any party may change its address by <br /> notifying the other parties of the change of address. Notice shall be deemed <br /> communicated within 48 hours from the time of mailing if mailed as provided by this <br /> Section. <br /> <br /> <br />
