REPORT
To the Honorable Mayor and City CounCil

December 2, 2002

Subject
Recommendation to amend the employment agreement of the City Attorney

Recommendation
It is recommended that the employment agreement of the City Attorney be amended to
adjust the base salary of the City Attorney and restate the rate of accrual of vacation leave.
The City Attorney's base compensation should be adjusted by 5% retroactive to the pay
period beginning on July 29, 2002. It is further recommended that the City Attorney's rate
of vacation leave accrual be restated as 25 work days per year effective July 29, 2002.
The City Council will review the City Attorney's pay for performance bonus which may be
up to ten percent (10%) at a later time.

Background
The City Council having conducted a performance evaluation of the City Attorney, it is
recommended to the City Council that the City Attorney receive a retroactive base salary
adjustment of 5%. The City Attorney's pay for performance will be reviewed at a future date
by the Council at the conclusion of his employment review. In addition, as the original
employment agreement intended but did not accurately reflect the rate of vacation accrual,
it should be restated as 25 work days per year.

Fiscal Impact
Sufficient funds exist within the 2002-2003 budget to address this adjustment. Any
additional adjustments to the cost and benefits will be presented to the Council in a mid-
year budget adjustment.

Jeff Ira ~--~ '~-~rn ~-
Vice Mayor Council Member
