<br />SWC:sh 1/11/84 <br /> <br />WHEREAS, RTD has filed its <br />affairs as required by Section <br />Bankruptcy Code; and <br />WHEREAS, by order dated July 12, 1984, the Bankruptcy Court <br />directed that all claims against RTD, not otherwise listed in its <br />schedules, be filed on or before September 3, 1984 or be forever <br /> <br />schedules <br />521(1) of <br /> <br />and <br />the <br /> <br />statement of <br />United States <br /> <br />barred; and <br />WHEREAS, the debtor and the principal creditors have agreed <br />to a disposition of the debtor's assets without the necessity of <br />completing the bankruptcy proceedings and without suffering the <br />delays inherent therein; and <br />WHEREAS, said agreement has been reduced to writing in the <br /> <br /> <br />form attached hereto and incorporated herein by reference; <br /> <br />NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY AS <br /> <br /> <br />FOLLOWS: <br /> <br /> <br />The agreement made as of the 1st day of October, 1984 by and <br /> <br /> <br />between RTD, as debtor and debtor in possession, Alan J. Rude, <br /> <br />and those school districts, municipalities, and corporate <br /> <br />entities listed on Schedule A annexed thereto, a copy of which is <br /> <br /> <br />attached hereto and incorporated herein by reference is hereby <br /> <br /> <br />approved and the City Manager is hereby authorized and directed <br /> <br />to execute, delivery and perform the said agreement in all <br /> <br /> <br />respects. <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />2 <br />
