0 R I G I N A L 11/17/97 <br /> <br /> RESOLUTION NO. 13253 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br /> OF ASSIGNMENT OF PERMANENT ENCROACHMENT PERMIT <br /> <br /> (SAFEWAY, INC.) <br /> <br /> WHEREAS, the City of Redwood City has granted Safeway, Inc., a <br />Permanent Encroachment Permit for parking purposes over City property located <br />next to Jefferson Avenue, Redwood City, California; and <br /> <br /> WHEREAS, Safeway, Inc., is conveying a portion of the land that it owns <br />at Sequoia Station to Pacific Retail Trust; and <br /> <br /> WHEREAS, as part of the conveyance, Safeway, Inc., desires to assign <br />all its rights, duties, and obligations to Pacific Retail Trust. <br /> <br /> NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF REDWOOD CITY, AS FOLLOWS: <br /> <br /> 1. That certain agreement entitled, "Assignment of Permit" (the <br />"Assignment") between Safeway, Inc., a Delaware corporation, and Pacific Retail <br />Trust, a Maryland Real Estate Investment Trust, a copy of which Assignment is <br />on file in the office of the City Clerk, to which copy reference is hereby made for <br />the full particulars thereof, is hereby approved, and the Manager and City Clerk <br />are hereby authorized and directed to execute, and to attest thereto, <br />respectively, said Assignment for and on behalf of the City of Redwood City. <br /> <br /> F:~shared\Redwood\Council\ 1 <br /> Reso-329 <br /> FXS:rg <br /> 11/10/97 <br /> <br /> <br />
