fiscal year 1993-94, and the amount properly posted to the Balancing Account <br />for fiscal year 1993-94; and <br /> <br /> WHEREAS, under the Master Agreement such disputes are subject to <br />arbitration, but demand for arbitration must be served on or before November 1, <br />1997, unless San Francisco and the Suburban Representatives otherwise agree <br />under Section 8.02(d) of the Master Agreement; and <br /> <br /> WHEREAS, it is desirable to allow time for further discussions to resolve <br />the dispute through agreement, rather than invoking arbitration; and <br /> <br /> WHEREAS, the Suburban Representatives, acting by and through the <br />San Francisco Bay Area Water Users Association propose to enter into an <br />agreement with San Francisco which would extend the time within which to <br />demand arbitration under the Master Agreement through March 31, 1998, and <br /> <br />this Council desires to enter into said agreement as a Suburban Representative; <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br />CITY, AS FOLLOWS: <br /> <br /> That certain agreement entitled, "Agreement Between the City and County <br />of San Francisco and the Suburban Representatives Under the Settlement <br />Agreement and Master Water Sales Contract" (form dated 9/16/97), extending <br />the time within which a demand for arbitration must be made under the Master <br />Agreement with respect to the above-described pending dispute, a facsimile <br />copy of which agreement is on file in the office of the City Clerk, to which copy <br /> <br /> Reso-309 2 <br /> G:~sharedYedwood~council <br /> DES:rg <br /> 10/01/97 <br /> <br /> <br />
