<br />DF.S:djg-c 6/3/83 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9363 <br /> <br />ORIGIN/~L <br />JUN 6 1983 <br /> <br />RESOLUTION OF NECESSITY PERTAINING TO THE ACQUISITION <br />OF CERTAIN STREET LIGHTING FACILITIES PURSUANT TO <br />EXERCISE OF THE POWER OF EMINENT DOMAIN <br /> <br />WHEREAS, the City of Redwood City requires certain street <br /> <br />lighting facilities for municipal purposes; and <br /> <br />WHEREAS, said facilities are currently owned by the Pacific <br /> <br />Gas and Electric Company, a public utility of the State of <br /> <br />California (PG&E); and <br /> <br />WHEREAS, pursuant to the provisions of Article 2 (commencing <br /> <br />with Section 1245.210), Chapter 4, Title 7, Part 3, of the Code <br /> <br />of Civil Procedure, this Council has held a hearing on the <br /> <br />question of public necessity with respect to said acquisition; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. The property to be acquired by the exercise of the power <br /> <br />of eminent domain consists of all those certain street lighting <br /> <br />facilities and appurtenances described in Exhibit "A" hereof, <br /> <br />attached hereto and by this reference incorporated herein. <br /> <br />2. This Council hereby finds, determines and declares that <br /> <br />the public use to which the property described in Exhibit "A" <br /> <br />hereof shall be put is the ownership, operation, maintenance and <br /> <br />repair of municipal street lighting facilities for the health, <br /> <br />welfare, comfort and benefit of the residents and general public <br /> <br />9 3 6 :-~ <br />
