�. i8 <br /> I �-! <br /> ���� <br /> D��s BEx�rrs ' <br /> 6.1 Designation of Beneficiary <br /> Each Participant and Inactive Participant shall have t�e �right to c�esignate a Beneficiary to <br /> receive the death benefits that are payable from ttris Plan. Such designation must be <br /> evidenced by a written �nstrument filed with the Employer on a foim prescribed by the <br /> Employer and signed by the Participant <br /> 6.2 Married Participant <br /> The Beneficiary for a mazried Participant sha11 at all times be the spouse at the date of <br /> death and may not be changed to someone other than such spouse unless the written <br /> consent of such spouse is provided upon a form acceptable to the Employer. Each such <br /> designation for benefits must be evidenced by a written instrument filed with the <br /> Employer on a�form prescribed by the Employer and signed by the Participant. If no <br /> such designation is on file with the Employer at the time of the death of the Participant, � <br /> or if for any reason at the sole discretion of the Employer such designation is defective, <br /> then the spouse of such Participant shall be conclusively deemed to be the Beneficiary <br /> designated to receive such benefit. <br /> 6.3 Spouse's Signature <br /> The signature of the Participant's spouse shall be required on a designation of beneficiary <br /> form or an application for a benefit under the Plan if the spouse is not the beneficiary, <br /> unless the Participant declazes in writing that one of the following conditions exists: <br /> (a) The Participant is not married; <br /> . (b) The Participant does not know and has taken all reasonable steps to determine the <br /> whereabouts of the spouse; <br /> (c) The spouse is incapable of execuring the aclrnowledgement because of an <br /> incapacitating mental or physical condition; <br /> (d) The Participant and spouse have executed a marrage settlement agreement pursuant <br /> to Part 5(commencing with section 1500) of Di`�ision 4 of the Family Code of the <br /> laws of California that makes the community property laws inapplicable to the <br /> marriage; <br /> (e) The current spouse has no identifiable community property interest in the benefits. <br /> 11 <br /> NB 1:538180Z <br />
