C�� 1 -52 <br /> � <br /> Article I <br /> DEFINITIONS <br /> 1.1 "Act" shall mean Califomia Govemment Code Sections 53215 - 53224, or their <br /> successor sections. <br /> 1.2 "Agreement for Administrative Services" shall mean the agreement executed <br /> between the Member Agency and the Trust Administrator which authorizes the <br /> Trust Administrator to perform spec�c duties of administering the Member <br /> Agency Plan and related Agency Trust. <br /> 1.3 "Amended Effective Date" shall mean July 1, 1999, the date the PARS Trust <br /> Agreement was amended and restated in its entirety. <br /> 1.4 "Assets" shall mean all contributions and transfers of assets received by an <br /> Agency Trust on behalf of a Member Agency's Plan, together with the income <br /> and eamings from such contributions and transfers and any increments accruing <br /> to them. <br /> 1.5 "Agency Trust" shall mean the legally separate and individual trust, whose <br /> provisions are identical to those of the PARS Trust Agreement, that is <br /> established by a Member Agency when it adopts the PARS Trust by executing <br /> an Adoption Agreement. <br /> 1.6 "Alternate Trustee" shall mean a trustee, other than the Trustee of the PARS <br /> Trust Program, appointed by a Member Agency to serve as a trustee of a portion <br /> of such Agency Trust's assets as to which the Trustee serves as custodian. <br /> 1.7 "Code" shall mean the Internal Revenue Code of 1986 as amended from time to <br /> time. <br /> 1.8 "Custodian" shall mean Union Bank of Cali�ornia, N.A. whose duties are limited <br /> to those specified in Section 4.3. <br /> 1.9 "Delegatee" shall mean an ir��vid���' or �tity, ?npointed by the Plan <br /> Administrator or Member Agenc � a� su� matte-� as are specified in the <br /> appointment. <br /> 1.10 "Effective Date" shall mean July 1, 1991, the date the PARS Trust Program was <br /> established. <br /> 1.11 "Investment Fiduciary" shall mean the fiduciary with the authority and duty to <br /> direct the investment and management (including the power to direct the <br /> 3 <br /> 2567_12 PEL <br />
