C� � l � �5g <br /> 2.2 Qualified Govemme�tal Retirement Trust <br /> The PARS Trust Program is established pursuant to the provisions of Section <br /> 501 of the Intemal Revenue Code of 1986, as amended (the "Code"), and • <br /> Califomia Govemment Code Sections 53215 through 53224 providing for <br /> pension trusts established by public agencies. <br /> 2.3 Date of Adoption <br /> The date as of which each Member Agency adopts the PARS Trust Program <br /> shall be the "Effective Date" of the PARS Trust Agreement and the Agency Trust, <br /> as defined in Section 2.5, as to that Member Agency. <br /> 2.4 Member Agencies - <br /> Any California public agency may, by action of its goveming body in a writing <br /> � accepted by the Trustee, adopt the provisions of the PARS Trust Agreement as <br /> the trust portion of a qualified governmental retirement plar �stablished for the <br /> benefit of its employees. Executing an adoption instrumer,: �or the PARS Trust <br /> Program ("Adoption Agreement"), attached hereto as Exhibit "A", shall constitute <br /> such adoption, unless the Trustee requires additional evidence of adoption. In <br /> order for such adoption to be effective, the public agency must also execute an ' <br /> Agreement for Administrative Services with Phase II Systems, the Trust <br /> Administrator, pursuant to section 3.6 of this PARS Trust Agreement. Such <br /> adopting employer shall then become a Member Agency of the PARS Trust <br /> Program. <br /> Each such Member Agency shall, at a minimum, fumish the Trust Administrator <br /> with the following documents to support its adoption of the PARS Trust Program: <br /> (a) a certified copy of the Member Agency goveming body resolution <br /> authorizing the adoption of the PARS Trust Agreement and the <br /> appointment of an individual designated by position of employment at the <br /> Member AgenCy to act on its behalf in all matters relating to the Member <br /> � Agency's participation in the PARS Trust Program and Agency Trust <br /> ("Plan Administrator"); <br /> (b) an original of the Adoption Agreement executed by the Plan Administrator <br /> or other duly authorized Member Agency employee; <br /> (c) an original of the Agreement for Administrative Services with Phase II <br /> Systems executed by the Plan Administrator or other duly authorized <br /> Member Agency employee and Phase II Systems; <br /> (d) an address notice; and <br /> 5 <br /> 2567 12 PEL <br />
