The Plan Administrator or its appointed <br /> Investment Fiduciary shall have full responsibility for designating the <br /> Investment Options under the Plan and for selecting the underlying <br /> investment vehicle(s) for each designated Investment Option into which a <br /> Participant may direct investment of his or her SelectBENEFIT Account. <br /> To the extent allowed by law, neither the Member Agency, the Plan <br /> Administrator, the Trust Administrator nor the Trustee shall have any <br /> responsibility for monitoring the directions of the Participant nor shall the <br /> Member Agency, the Plan Administrator, the Trust Administrator or the <br /> Trustee be liable in any manner for investment or other losses or other <br /> liability for following directions of a Participant. <br /> (c) If SelectBENEF/T Accounts are established, notwithstanding any other <br /> provision of this Trust Agreement, the Member Agency may appoint the <br /> Trustee to provi�e ministerial services as recordkeeper for such accounts <br /> by so indicating in the Member Agency's Adoption Agreement, provided <br /> that an acceptable service agreement has been executed by and befinreen <br /> the Member Agency, the Plan Administrator, the Trustee and the Trust <br /> Administrator. <br /> Article VI <br /> FIDUCIARY RESPONSIBILITIES <br /> 6.1 More Than One Fiduciary Capacity <br /> Any one or more of the fiduciaries with respect to the PARS Trust Agreement or <br /> the Agency Trust may, to the extent require� thereby or as directed by the Plan <br /> Administrator pursuant to this PARS Trust Agreement and the Plan, serve in <br /> more than one fiduciary capacity with respect to the PARS Trust Agreement, the <br /> Agency Trust and the Plan. <br /> 25 <br /> 2567 12 PEL <br />
