10A <br /> Page 8 <br /> Encroachment Permits <br /> AB 2987 requires a local entity to either approve or deny an application from a holder of a state <br /> franchise for an encroachment permit within 60 days of receiving a completed application. An <br /> application for an encraachment permit is campiete when the applicant has comp(ied with all <br /> statutory requirements, including the California Environmental Quali#y Act{CEQA). 1f the local <br /> entity denies an application for an encroachment permit it sha11 furnish to the applicant a detailed <br /> explanation of the reason for the denial. <br /> Customer Service <br /> Enforcement of custamer service standards is still under the authority of local governments. <br /> Fiowever, the authority in AB 2987 is weak in comparison with the authority local governments <br /> had under local franchise agreements. <br /> The loca!entity sha8 enforce all of the cusfomer service and protection standards with respect to <br /> complaints received from residents within the local entity's jurisdiction, bu# it may no#adopt or <br /> seek to enforce any additionai or different customer service or other performance standards. <br /> Franchise Fees <br /> Franchise fees are set at five percent of gross revenues and wi11 go directly to cities as they did <br /> befiore. <br /> League Efforts <br /> The League has heard from many local entities about the telecom survey the industry put out with <br /> cooperation from the League. Telephone companies continue to request that cifies fill out the <br /> survey.
