However, when a sign poses a serious and immediate threat to public health or safety by virtue of its physical conditian, without cansideration of the message thereon, then the threat may be summarify abated by the City, with the reasonable cost of abatement chargeable #o �he sign owner and or property owner. Sec. 3.1�2. ABANDONED SIGNS ANDIOR DISPLAY: Abandoned signs shall be promptly remov�d by the property owner or person responsible for its installa#ion and/or maintenance. The City may declare such signs to be a public nuisance and abate it pursuant to Business and Professions Code sections 5459.2 et seq., or City law on abat�me.n.� c�f nui��n�eG. Sec. 3.103. (NVENTORY OF lLLEGAL AND ABANDONED SlGNS: In connection with the ado�tion of a pr�ar versian of this Article, in 199J fihe Ciiy conciucted an inventory of nonconforming signs and hefd a pubiic hearing to confirm the 1999 version of the sign ordinance. Because this versian of the sign ordir�ance does not impose new restrictions on onsi#e commercial signage, it is no# necessary to conduct a new inventory or hoid a new confirmation hearing. This Section does not apply to signs and structures which are subject to Business and Professions Code section 5412. The City of Redwaod City validates and reconfirms the inventory of nonconforming signs which was conducted in 1999, except that for amortization purposes under this Article, nonconformance under ths 1999 inventory shall be limited to noncommunicative aspects of the subject signs, and not upon message content; however, the on-site / off- site distinction is cansidered to be based on location, not content. Sec. 3.104. NONCONFORMtNG S1GNS: Any sign which becomes nonconforming as a rps�!t �f #he �ro.�►.'s;ons of thi� ��:icle, or provi�ions �f a prior version of the sign ordinance which operated to the same effect, shall be considered to be an illegal sign afiter the amortization period provided in the amortization chart of this 5ection has expired and conformance has not been acc�mplished. Relocation and a{teration. No nonconforming sign shall be movsd, enlarged in size or raised in height unless such relocation, alteration or enlargement is required by faw or brings the sign into conformance with the pravisions af this Article. Modification of a nonconforming sign may be permitted through the sign permit application process so long as it is determined that there is an increase in the levef of conformity of the subject nonconfarming sign.
