Owen, dba Owen Built,

San Jose, California, dated September 7, 1982, and found and declared

said bidder to be the lowest responsible bidder for the work of Tennis

Court Resurfacing - Red Morton Community Park and Mezes Park; and

WHEREAS, subsequent to the acceptance of such bid by this

Council, the City's Department of Public Works became aware that said

bid filed by said Albert K. Owen, dba Owen Built, contained serious

irregularities, viz.: the named bidder did not, in fact, possess the

proper contractor's license to enable him to do the work for which he

bid, although the bidder had indicated he did possess such license;

and the contractor's license number which the bidder submitted with

his bid was, in fact, the number of another contracting firm with

which the bidder is also associated; and

WHEREAS, although given an opportunity by the Director of Public

Works to explain why the award should not be rescinded, the bidder has

not responded in a manner satisfactory to this Council;

NOW, THEREFORE;

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY,

AS FOLLOWS:

1. This Council hereby finds and declares the bid of Albert K.

Owen, dba Owen Built, for Tennis Court Resurfacing, dated September 7,

Q ') 5 Fl
,] 1-.01 '. S
