Amendments 1 and 2 re-structured the payment <br /> of previously authorized fees ($1.5 million) to correspond with the three separate <br /> phases of construction. Amendment No. 3 dated Qctober 20Q5, for $280,226.91 <br /> provided for additional canstruction management services made necessary by <br /> unanticipated project conditians, Amendment Na. 4 dated March 2006, for $55,272.72 <br /> provided for post canstruction management/contract administration services. <br /> Amendment No. 5 for a not-to-exceed amount af $45,400 is propased ta provide for <br /> services ta resolve and negotiate a post canstruction disagreement between the City <br /> and the Contractar on the cost and enti#{ement of additional work performed by the <br /> Contractor. The Contractor's claim far additional work totals $6QQ,OQQ, whereas the City <br /> believes additional work performed totals $200,000. The fee estimate assumes tha# the <br /> dispufie will be settled without arbitration or litigation. <br /> ALTERNATNES <br /> Council may choose nat to apprave An�endment No. 5 and delay the project cfose-out <br /> and subsequent acceptance of the project by Caltrans. <br /> FISCAL IMPACT <br /> Funding for fhe proposed amendment is avaifable from the Redwood Shares <br /> Transportation Improvement District and fha State Transportation Improvement Grant. <br /> There is no impact to the City's General F'und. <br />
