7A <br /> Page 8 <br /> The duty of VENDOR to indemni#y and save harmless, as set forth herein, <br /> shal! include the duty to defend as set forth in Section 2778 of the California <br /> Civil Cade; provided, however, that nothing herein contained shall be <br /> construed to require VENDOR to indemnify City, its Council, boards, <br /> commissions, officers, employees and agents against any responsibility or <br /> liabilit�r in contravention of Section 2782 of the Cali#ornia Civif Code. <br /> 12. lnsurance. VENDOR shall acquire and maintain Warkers' Compensation, <br /> employer's liabii'rty, commercial general liability, owned and non-owned and <br /> hired automobile (iability coverage relating to VENDOR's services to be <br /> performed hereunder cover"rng City's risks in form subject to the approval of <br /> the Ci#y Attorney and/or City's Risk Manager. The minimum amounts of <br /> caverage corresponding to the aforesaid categories of insura�ce per <br /> insurable event shafl be as fallows: <br /> insurance Categorv Minimum Limits <br /> Workers' Compensation statutory minimum <br /> Empfoyer's Liability $1,000,000 per acciden# for bodily <br /> injury ar disease <br /> Commercial General $1,000,000 per occurrence and <br /> �.iabil'rty $2,000,000 aggrega#e for bodi(y <br /> injury, personal injury and property <br /> damage <br /> Automobile Liability $1,004,000 per accident for bodily <br /> injury and property damage <br /> (coverage required to the extent <br /> appEicable to <br /> VENDOR's vehicle usage in <br /> performing services hereunder) <br /> Concurrently with the execution af this Agreement, VENDOR shalE, on the <br /> forms provided in Exhibit D, furnish City with certificates and copies of <br /> information or declaration pages of the insurance requited hereunder and, <br /> with respect to evidence of cammercia! general liability and automobife <br /> liabiliiy insurance coverage, ariginal endorsements: <br /> (a) Precluding cancellation or reduction in coverage before the <br /> expiration of thirty (30� days after City shaN have received written <br /> notifica#ion of canceilation or reduction in coverage by first class <br /> mail; <br /> {b� Providing that VENDOR's insurance shall apply separately to each <br /> insured against whom clairn is made or suit is brought, except with <br /> 4 <br />
