FRANCIS STREET); AND APPROVING AGREE:r1ENT FOR CONSTRUCTION OF U1PROVE}1ENTS IN CONNECTION THEREWITH WHEREAS, this Council has been informed by the Director of Public Works that a house at 1320 St. Francis Street is in danger of sliding into Redwood Creek as a consequence of the collapse of a large portion of an adjacent concrete drainage channel wall and earth embankment due to recent heavy rains; and WHEREAS, Section 68 of the Charter of the City of Redwood City provides that the City Council in the case of a great public calamity, such as damage caused by flooding, may determine that public necessity requires the expenditure of public funds to preserve life and property without compliance with formal bidding procedures; and WHEREAS, this Council declares and determines that the expenditure of public funds for the construction of improvements in connection wi th the preservation of the house at 1320 St. Francis Street necessitated by the collapse of the wall and earth embankment is in the public interest as described in the aforementioned section of the Redwood City Charter; NOW, THEREFOHE; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. This Council hereby finds that the expenditure of public funds for the construction of improvements in connection with the preservation of the house at 1320 St. Francis Street made necessary by the collapse of the wall and earth embankment adjacent to Redwood Creek is in the public interest. 9 037
