RE~t~~` <br />To the Honorable Mayor and City Council and <br />Redeveloprnen# agency From the City Manager and <br />the Executive Direct®r <br />June 4, 2007 <br />SUBJECT <br />Assignment and assumption of easement; Agency lease for concession space 1A; City <br />license for food service in license area 1A Courthouse Square: <br />RECOMMENDATION <br />1. Approve by motion the assignment of easement far the four concessron lease areas <br />at Courthouse Square from the City to the Redevelopment Agency ("Agency"} <br />2. Authorize the Agency to execute a lease with Asian Vision Corporation doing <br />business as "Fatt Dog" for Lease Area 1A in Courthouse Square <br />3. Authorize the City to execute a license with Asian Vision Corporation doing business <br />as "Fatt Dog" for License Area 1A in Courthouse Square <br />BACKGROUND <br />In May 2005, Redwood City entered into a 55-year (with 4 ten-year renewals) Grant of <br />Easement and License Cooperative Agreement with the County of San Mateo to create <br />Courthouse Square, reconstruct the Courthouse facade, and preserve the historic <br />County Courthouse Block. The Cooperative Agreement provides the City authority to <br />assign its entire easement interest in any or all portions of the Courthouse Square with <br />the consent of the County. The County has provided the City with a letter, dated May <br />15, 2007 (see Attachment 1) consenting to the assignment of easement from the City to <br />the Agency. for the four concession spaces: Lease Areas 1A, 2A, 1 B, and 2B as shown <br />in Attachment 2. <br />In 2006, the County amended the Cooperative Agreement to allow the City to install <br />restrooms within the City's easement area for use by the genera! public. Placing <br />restrooms within 300 feet of the Courthouse Square pavilions satisfies the County <br />Health Department's requirements for food vendors in the concession spaces. <br />Assignment of Easement <br />The area proposed for easement assignment to the Agency are the four concession <br />spaces located within the two pavilions at Courthouse Square as shown as Lease <br />Areas 1A, 2A, 1B, and 2B in Attachment 2. All concession spaces consist of a 190 <br />square foot (approximately 13' x 14') enclosed area intended far future retail and food <br />service businesses. Assigning the easement allows the Agency to manage and ensure <br />the appropriate mix of retail goods and services by entering into leases with these <br />businesses. The City desires to facilitate the Agency's objective by assigning an <br />easement for each concession space to the Agency. <br />6.1 E <br />iae 1 <br />
