6.1 E <br />Page 3 <br />The license fee is a nominal amount to encourage Fatt Dog to clean and secure the <br />tables and chairs provided by the City. In an effort to ensure a successful start, Asian <br />Vision Corporation will not pay the license fee until its monthly gross sales exceed <br />$20,000 after the sixth month of operations. Asian Vision Corporation will pay the City <br />$600 for the common area maintenance commencing July 1, 2007. <br />License fees collected will fund City sponsored or co-sponsored special events at <br />Courthouse Square. The common area maintenance charges collected wilt fund a <br />portion of the maintenance of Courthouse Square such as power washing and <br />landscaping. <br />ALTERNATIVES <br />Do not assign the easement to the Agency which would limit the City's ability to select <br />vendors. The City would have to select vendors based upon either the highest <br />responsible bidder at public auction or upon seated bids, hence delaying the occupancy <br />of concession spaces. <br />Do not execute the Lease and License with Asian Vision Corporation. The City and/or <br />Agency would need to seek another vendor, which would delay occupancy of the <br />Courthouse Square concession space. <br />FISCAL IMPACT <br />There is no fiscal impact for the assignment of an easement. Lease rent for the first <br />year ranges from $12 to $3,600, depending on gross sales. License fees will range <br />from $0;00 to $500 annually depending on Fatt Dog's gross sales. The estimated <br />annual cost of maintenance for Courthouse Square is $183,000 as proposed in the City <br />2007 to 2008 Budget. Asian Vision Corporation wilt pay common area maintenance of <br />$600 per month ($7,200 annually) to partially fund the Courthouse Square maintenance. <br />Each new vendor will be expected to pay his/her fair share of the maintenance based <br />on their space allocations.
