Executive Order 11246, amended by Executive Order 12086, Equal <br /> Employment and Contracting Opportunities, which provide that no <br /> person shall be discriminated against on the basis of race, color, <br /> religion, sex, or national odgin in all phases of employment during <br /> the performance of federally assisted construction contracts. <br /> <br /> 8. Housing and Urban Development Act of 1968, Section 3, which <br /> requires that, in the planning and carrying out of any project <br /> assisted under the Act, that to the greatest extent feasible, <br /> opportunities for training and employment be given*to Iow and <br /> moderate income persons residing within the unit of local <br /> government in which the project is located, and that contracts for <br /> work in connection with the project be awarded to eligible business <br /> concerns which are located in, or owned in substantial part by <br /> persons residing in the same unit of local government as the <br /> project. <br /> <br /> 9. Lead-Based Paint Poisoning Act, which prohibits the use of lead- <br /> based paint in residential structures constructed or rehabilitated <br /> with Federal assistance. <br /> <br />- I. CONFLICT OF INTEREST <br /> <br /> No members, partners, officers, or employees or agents of Contractor, no <br /> member of the Board of Directors, and no other official who exercises any <br /> function Or responsibility with respect to .this program during his/his tenure, or for <br /> one year thereafter, shall have any interest, direct or indirect, in the agreement or <br /> a related contract, or the proceeds thereof. Contractor shall incorporate in all <br /> contracts hereunder a provision prohibiting such interest. <br /> <br /> Contractor shall keep detailed and accurate records of all expenditures made <br /> and expenses incurred which are funded under this agreement. Payments of <br /> funds allocated pursuant to paragraph 1 shall be made to Contractor on a <br /> reimbursement basis as follows: (i) Contractor shall submit requests for payment <br /> to City monthly on forms provided by City's Housing Coordinator; (ii) all requests <br /> for payment shall be accompanied by receipts or other proof of expenditure, and <br /> shall disclose amounts of Program income, if any, generated by user fees; (iii) <br /> contractor shall submit billings over a ten month period. Final payment must be <br /> submitted and received by the City no later than June 20, 2003 pursuant to <br /> Paragraph A2, Exhibit A; (iv) such income amounts shall be subtracted from <br /> corresponding requests for payment; and (v) Program income shall be expended <br /> by Contractor prior to requesting additional reimbursements from City. <br /> <br /> F:Atty/Agr/Agr.083 <br /> 121002 17 <br /> <br /> <br />
