<br />(Page l3 of 20) <br /> <br />servitudes that benefit and bind each Lot and each Lot OWner and successive Lot OWner thereto. Lot OWners <br />shall be liable under this Declaration only for defaults committed during the period the Lot owner held title to <br />all or any portion of a Lot and shall not be liable for any defaults committed by any predecessor or successor <br />Lot Owner unless assumed in writing. <br /> <br />6.8 Ass~nment. Declarant may assign all or any portion of its rights under this Declaration to any <br />other person or entity by executing and delivering to the assignee a written instrument of assignment. <br /> <br />6.9 Amendments. This Declaration may be amended from time to time with the written consent <br />of a Majority of the Lot owners, provided that no amendment that affects the easement rights of the Owner of <br />any property subject to this Declaration may be made without the written consent of that owner. The <br />amendment shall be in writing, shall be signed by the Owners of at least two Lots, and shall be certified by such <br />Lot Owners thatthe amendment was duly adopted as required herein. The amendment shall be effective when <br />recorded in the records of San Mateo County, California. <br /> <br />Notwithstanding any language to the contrary, no amendment relating to compliance with the publicly <br />required maintenance standards or the City's Planned Development Permit, or any other provision of this <br />Declaration as it relates to the maintenance of the driveway and Open Space Area, including private streets, <br />or which otherwise would terminate or materially impair other rights of the City as set forth in this Declaration <br />shall be effective and may be made or recorded without the prior written consent of the City as authorized by <br />the City Manager. <br /> <br />6.10 Effective Date. The easements, covenants, restrictions, benefits, burdens, rights and duties <br />set forth in this Declaration shall be effective automatically on the date that Declarant first transfers title to a <br />Lot to a third party without regard to whether the instrument of transfer describes this Declaration or <br />incorporates this Declaration by reference. <br /> <br />OAKWOOD DRIVE RWC.
