<br />6.4A <br />Page 1 <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE OF THE CITY COUNCil OF THE CITY OF REDWOOD <br />CITY DESCRIBING THE REDWOOD CITY REDEVELOPMENT <br />AGENCY'S PROGRAM TO ACQUIRE REAL PROPERTY BY EMINENT <br />DOMAIN PURSUANT TO THE REDEVELOPMENT PLAN FOR <br />PROJECT AREA NO.2 <br /> <br />WHEAREAS, the Council of Redwood City (the "Council") adopted the <br />Redevelopment Plan for Redevelopment Project Area No. 2 (the "Project Area") on <br />August 19, 1982 by Ordinance No. 1862 and has amended the Redevelopment Plan as <br />follows: by Ordinance No. 1911 approved on June 20, 1985; by Ordinance No. 2007 <br />approved on January 18, 1990; by Ordinance No. 2085 approved on December 19, <br />1994; by Ordinance No. 2211 approved on July 9, 2001 (as amended the <br />"Redevelopment Plan"); and <br /> <br />WHEREAS, the Community Redevelopment Law (the "CRL;" California Health <br />and Safety Code Section 33000 et seq.) permits the adoption of redevelopment plans, <br />redevelopment plan amendments, and redevelopment plan mergers; and <br /> <br />WHEREAS, Senate Bill 53 (Kehoe) ("SB 53"), adopted by the California <br />Legislature during the 2006 Legislative Session and codified as California Health and <br />Safety Code section 33342.7. requires that a Redevelopment Agency which adopted a <br />final redevelopment plan on or before January 1, 2007 to adopt an ordinance describing <br />the Agency's program to acquire property by eminent domain (the "Program"); and <br /> <br />WHEREAS, the Council desires to adopt this Ordinance to describe the Program <br />as required by sa 53 and Section 33342.7. <br /> <br />NOW, THEREFORE, THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS <br />FOLLOWS: <br /> <br />SECTION 1. The purpose and intent of the Council in adopting this Ordinance is <br />to comply with SB 53 and Health and Safety Code section 33342.7. <br /> <br />The overall object of the Agency is to continue its efforts to eliminate or alleviate <br />conditions of blight; ensure, as far as possible, that the causes of blighting conditions <br />will either be eliminated or protected against; encourage and ensure the redevelopment <br />of the Project Area: encourage and foster the economic revitalization of the Project <br />Area, as necessary; and provide and improve affordable housing. <br /> <br />SECTION 2. The Council hereby adopts and approves the description of the <br />Agency's program to acquire property by eminent domain (the "Program") as more fully <br />described in Exhibit "A" attached hereto and incorporated herein by this reference. <br /> <br />A TTY/ORD/ORD.280 <br />053107 <br /> <br />1 <br />
