<br />REPORT <br /> <br />6.18 <br />age 1 <br /> <br />To the Honorable Mayor and City Council <br />from ttle Ci .' M~naer <br /> <br />June 25, 2007 <br /> <br />SUBJECT <br />Amendment NO.2 to the Cooperative Agreement with the Department of Transportation for <br />the Route 101 at Ralston/Marine Parkway Interchange Project. <br /> <br />RECOMMENDATION <br />Approve, by motion, Amendment NO.2 to the Cooperative Agreement with the California <br />Department of Transportation (CaITrans) for the construction of the Route 101/Ralston <br />Avenue/Marine Parkway Interchange Reconfiguration Project, and authorize the City <br />Manager to execute the same. <br /> <br />BACKGROUND <br />On June 23, 2003. Council approved the original Agreement between CalTrans and the <br />City for the construction of the interchange at Route 101 and Ralston/Marine Parkway. The <br />Agreement outlines the project related rights and responsibilities of the State and the City. <br />In June 2005, Amendment No. 1 which provided for the City's reimbursement of the State <br />for State furnished materials was approved, executed, and subsequently nullified. <br /> <br />Although work on this project is substantially complete, landscaping of the interchange will <br />not be fully completed before the Agreement is due to expire on June 30, 2007. The <br />proposed Amendment No.2 extends the term of the existing Agreement until June 30, <br />2009, to accommodate the landscaping project which is anticipated to begin this winter. <br /> <br />As well, Amendment NO.2 replaces the existing and dated language of the indemnification <br />articles at the State's request. <br /> <br />ALTERNATIVES <br />Council may elect not to approve the proposed amendment, and allow the agreement to <br />expire before the City satisfies all the conditions of the agreement. <br /> <br />FISCAL IMPACT <br />There is no known fiscal impact to the City's budget as this project is fully funded through <br />Sp~ial District fu and Slate Transportation Imp~A:::gram grants~ <br /> <br />( " ~ <br /> <br />W Chu Chang, P.E. <br />IU .
