M~naer June 25, 2007 SUBJECT Amendment NO.2 to the Cooperative Agreement with the Department of Transportation for the Route 101 at Ralston/Marine Parkway Interchange Project. RECOMMENDATION Approve, by motion, Amendment NO.2 to the Cooperative Agreement with the California Department of Transportation (CaITrans) for the construction of the Route 101/Ralston Avenue/Marine Parkway Interchange Reconfiguration Project, and authorize the City Manager to execute the same. BACKGROUND On June 23, 2003. Council approved the original Agreement between CalTrans and the City for the construction of the interchange at Route 101 and Ralston/Marine Parkway. The Agreement outlines the project related rights and responsibilities of the State and the City. In June 2005, Amendment No. 1 which provided for the City's reimbursement of the State for State furnished materials was approved, executed, and subsequently nullified. Although work on this project is substantially complete, landscaping of the interchange will not be fully completed before the Agreement is due to expire on June 30, 2007. The proposed Amendment No.2 extends the term of the existing Agreement until June 30, 2009, to accommodate the landscaping project which is anticipated to begin this winter. As well, Amendment NO.2 replaces the existing and dated language of the indemnification articles at the State's request. ALTERNATIVES Council may elect not to approve the proposed amendment, and allow the agreement to expire before the City satisfies all the conditions of the agreement. FISCAL IMPACT There is no known fiscal impact to the City's budget as this project is fully funded through Sp~ial District fu and Slate Transportation Imp~A:::gram grants~ ( " ~ W Chu Chang, P.E.
