<br />Attachment I <br /> <br />Premises") described on Exhibit "B," attached hereto and incorporated by this reference, within which <br /> <br />Lessee desires to construct and maintain improvements and equipment, as described on Exhibit "e," <br /> <br />attached hereto and incorporated by this reference. Lessor and Lessee hereby agree that the Leased <br /> <br />Premises including any Access Areas (defined below) may be surveyed by a licensed surveyor at the sole <br /> <br />cost of Lessee, and such survey shall then supplement Exhibit "B," and become a part hereof and shall <br /> <br />control to describe the Leased Premises and Access Areas in the event of any discrepancy between such <br /> <br />survey and the description of the boundary of the Leased Premises contained herein. <br /> <br />2. TERM:; OPTION. (a) The terms of this Lease (the "Tenn") shall be Five (5) years <br /> <br />commencing on , 2007, (the "Commencement Date") and terminating on the Fifth <br /> <br />anniversary of the Commencement Date, unless earlier terminated as provided in this Lease; (b) Lessee is <br /> <br />granted Two (2) consecutive Five (5) year renewal terms (collectively, the "Renewal Terms"), commencing <br /> <br />upon the expiration of the Tenn. Each Five (5) year Renewal Tenn shall automatically renew unless Lessee <br /> <br />notifies Lessor in writing at least ninety (90) days prior to the commencement of each Renewal Term that <br /> <br />the Lease is not to be renewed. <br /> <br />3. RENTAL. (a) Lessee shall pay to the Lessor as rent during the Tenn for the Leased <br /> <br />Premises in advance on the Commencement Date and on each yearly anniversary date thereof without <br /> <br />deduction, offset, prior notice or demand, in lawful money of the United States, the sum of Twelve <br /> <br />Thousand and No/100 Dollars ($12,000) per Lease Year; (b) There shall be a four (4) percent increase in <br /> <br />the rent commencing on the fifth Lease Year. The rent during the fifth Lease Year shall therefore be <br /> <br />Twelve Thousand Four Hundred Eighty Dollars and No/IOO ($12,480). Thereafter, there shall be a yearly <br /> <br />increase offaur percent (4%) on each Anniversary Date over the rent set during the immediately preceding <br /> <br />Lease Year. <br /> <br />In the event that this Lease is terminated by mutual agreement prior to the expiration ofany Term, <br /> <br />Lessee shall be reimbursed for the remaining paid rent on a prorated basis (365 day basis), subject to any <br /> <br />offsets for past rent due or other costs, if any. <br /> <br />4. USE. <br /> <br />4.01 Permitted Uses.
