Attachment I Premises") described on Exhibit "B," attached hereto and incorporated by this reference, within which Lessee desires to construct and maintain improvements and equipment, as described on Exhibit "e," attached hereto and incorporated by this reference. Lessor and Lessee hereby agree that the Leased Premises including any Access Areas (defined below) may be surveyed by a licensed surveyor at the sole cost of Lessee, and such survey shall then supplement Exhibit "B," and become a part hereof and shall control to describe the Leased Premises and Access Areas in the event of any discrepancy between such survey and the description of the boundary of the Leased Premises contained herein. 2. TERM:; OPTION. (a) The terms of this Lease (the "Tenn") shall be Five (5) years commencing on , 2007, (the "Commencement Date") and terminating on the Fifth anniversary of the Commencement Date, unless earlier terminated as provided in this Lease; (b) Lessee is granted Two (2) consecutive Five (5) year renewal terms (collectively, the "Renewal Terms"), commencing upon the expiration of the Tenn. Each Five (5) year Renewal Tenn shall automatically renew unless Lessee notifies Lessor in writing at least ninety (90) days prior to the commencement of each Renewal Term that the Lease is not to be renewed. 3. RENTAL. (a) Lessee shall pay to the Lessor as rent during the Tenn for the Leased Premises in advance on the Commencement Date and on each yearly anniversary date thereof without deduction, offset, prior notice or demand, in lawful money of the United States, the sum of Twelve Thousand and No/100 Dollars ($12,000) per Lease Year; (b) There shall be a four (4) percent increase in the rent commencing on the fifth Lease Year. The rent during the fifth Lease Year shall therefore be Twelve Thousand Four Hundred Eighty Dollars and No/IOO ($12,480). Thereafter, there shall be a yearly increase offaur percent (4%) on each Anniversary Date over the rent set during the immediately preceding Lease Year. In the event that this Lease is terminated by mutual agreement prior to the expiration ofany Term, Lessee shall be reimbursed for the remaining paid rent on a prorated basis (365 day basis), subject to any offsets for past rent due or other costs, if any. 4. USE. 4.01 Permitted Uses. Lessee shall use the Leased Premises as one of Lessee's mobile radio/telephone base station (a "Base Station") comprising Lessee's system (the "System") for furnishing Lease Agreement-Communications Site - POE Tower (Redwood Shores Parkway aDd Radio Road) - Revl (215/07) 6.1C Page 4 2
