If Lessee contests the validity of any such lien, claim or demand in good <br /> <br />faith, then Lessee shall, at its sole expense, defend itself and Lessor against the same and shall pay and <br /> <br />satisfy any such adverse judgment that may be rendered thereon before the enforcement thereof against the <br /> <br />Lessor or the Leased Premises. If Lessor shall require, Lessee shall furnish to Lessor a surety bond <br /> <br />satisfactory to Lessor in an amount equal to such contested lien, claim or demand indemnifYing Lessor <br /> <br />against liability for the same and holding the Leased Premises free from the effect of such Hen or claim, <br /> <br />(c) Any alterations, improvements, additions or utility installations which may be <br /> <br />made on the Leased Premises by Lessee and which are not covered tmder Paragraph 5.01 shall, upon <br /> <br />Lessor's option, remain, in whole or in part, the property of Lessor at the end of the term. <br /> <br />(d) Before the construction of any Improvements is commenced on the Leased <br /> <br />Premises and before any building materials therefor have been delivered to the Leased Premises by Lessee <br /> <br />or agents under Lessee's authority, Lessee shall comply with the following conditions or procure Lessor's <br /> <br />written waiver of the condition or conditions specified in the waiver: <br /> <br />(1) Visual and Environmental Impact. Lessee shall use its best efforts to <br /> <br />make any Improvements on the Leased Premises aesthetically pleasing and environmentally neutral. <br /> <br />Notwithstanding tbe foregoing, Lessor reserves the right to require that reasonable measures be undertaken <br /> <br />to improve the visual or environmental impact of any proposed improvement or alterations of the Leased <br /> <br />Premises. <br /> <br />(2) Construction Schedule. Lessee shall deliver to the Lessor for the <br /> <br />Lessor's approval a time schedule setting forth in detail a description of the Improvements and all steps for <br /> <br />construction of the Improvements, and Lessee's best estimate of the date upon which each step shall be <br /> <br />substantially completed. The Lessor's approval, which shall not be unreasonably withheld, or disapproval <br /> <br />of the schedule shall be communicated to Lessee in the manner provided for the giving of notice herein and <br /> <br />any disapproval shall be accompanied by a specification of the grounds for disapproval. <br /> <br />(3) Protection of Adiacent Property. hldemnity of the Lessor. Lessee shall <br /> <br />protect Lessor's property against damage resulting from the performance of any work undertaken by <br /> <br />Lessee or Lessee's agents, employees, contractors, or assigns, and shall indemnii)r the Lessor against all <br /> <br />Lease Agreement-Communications Site - PGE Tower (Redwood Shores Parkway and Radio Road) - Revl (215107) <br /> <br />7 <br />
