<br />. . <br /> <br />5.05 Improvements. <br /> <br /> <br />(a) Lessee has the right to erect, maintain, and operate on the Leased Premises radio <br /> <br /> <br />communications facilities, including an antenna tower or pole(s) and foundation, utility lines, transmission <br /> <br /> <br />lines, an air~conditioned equipment shelter, electronic equipment, radio transmitting and receiving antennas <br />and supporting structures thereto ("Lessee's Facilities"). In connection therewith, Lessee has the right to <br />do all work reasonably necessary to prepare, maintain and alter the Leased Premises for Lessee's business <br />operations and to install transmission lines connecting the antennas to the transmitters and receivers. <br />Lessee's construction and installation work or other work shall be performed at Lessee's sole cost and <br />expense and in a good and workmanlike manner. Title to the Lessee's Facilities shall be held by Lessee. <br />The Lessee's Facilities shall remain Lessee's personal property and are not fixtures. Lessee has the duty to <br />remove all Lessee's Facilities at its sole expense on or before the expiration or earlier termination of the <br />Lease. <br /> <br />Any alterations, improvements, additions or utility installations (hereinafter collectively referred to <br /> <br /> <br />as "Improvements") to or on the Leased Premises that are necessary for the conduct of the permitted uses <br /> <br /> <br />of the Leased Premises are subject to the prior written approval of (I) the Lessor, which approval shall not <br />be unreasonably withheld or delayed, and, if necessary; (2) all other governmental agencies, including the <br />City, which have jurisdiction over the use of the Leased Premises by Lessee; (3) Pacific Gas and Electric <br />Company and; (4) T~Mobile. In order to obtain Lessor's prior written approval for any Improvement, <br />Lessee shall submit maps and drawings or renderings of any proposed improvement to Lessor, sufficiently <br />detailed to enable Lessor to make an informed judgment about any proposed improvements and shall <br />further provide evidence of written approval by other agencies, Pacific Gas and Electric Company and T- <br />Mobile. Should Lessee make any Improvements without the prior approval of Lessor, Lessor may require <br />that Lessee to remove any or all of the same at Lessee's sole cost and expense. <br />(b) Lessee shall pay, when due, all claims for labor or materials furnished or alleged <br />to have been furnished to or for Lessee at or for use on the Leased Premises, which claims are or may be <br /> <br />secured by any mechanics' or materialmen's lien against the Leased Premises or any interest therein. <br /> <br />Lessee shall give Lessor not less than ten (IO) days' notice prior to the commencement of any work on the <br /> <br />Leased Premises, and Lessor shall have the right to post notices of non-responsibility in or on the Leased <br /> <br />Lease Agreement-Communications Site - PGE Tower (Redwood Shores Parkway and Radio Road) - Final Rev3 (5/18/07) <br /> <br />6 <br />
