<br />'. <br /> <br />liens or liability in any way arising out of the performance of the work or the furnishing of labor, services, <br />materials, supplies, equipment or power in connection therewith on behalf or for the benefit of Lessee. <br />(4) Insurance. In addition to the insurance coverage otherwise required <br />under this Lease, Lessee shall maintain or cause to be maintained Workers' Compensation Insurance <br /> <br /> <br />covering all persons employed in connection with the construction of any Improvements, repair or <br /> <br /> <br />maintenance activities with respect to whom death or injury claims could be asserted against the Lessor, <br /> <br /> <br />Lessee or the Leased Premises. Lessor may require that any third parties performing work on the Leased <br />Premises maintain such Workers' Compensation Insurance as well. Such insurance shall be maintained at <br />Lessee's sole cost and expense at all times when any work is in process and shall otherwise conform to the <br />requirements of this Lease for insurance. <br />(5) Notice of Completion. Immediately on substantial completion of any <br />improvement, Lessee shall prepare and provide Lessor with a notict; of completion suitable for recordation <br />in the official records of the County of San Mateo. Lessor, at its option, may elect to record said notice. <br />(6) Notice of Changes in Plans. On completion of any Improvement, <br />Lessee shall give the Lessor notice of all changes in plans and specifications made during the course of the <br />work and shall at the same time deliver to the Lessor "as built" drawings accurately reflecting all such <br />changes; provided, no change that substantially alters the final plans last approved by the Lessor shall be <br />made without the Lessor's prior written approval, which shall not be unreasonably withheld or delayed. <br /> <br /> <br />(e) Lessee shall fully comply with any reasonable landscaping requirements or <br /> <br /> <br />conditions included as part of any governmental approval of Lessee's use of the Leased Premises, including <br /> <br /> <br />all maintenance, repair and replacement provisions. <br /> <br /> <br />6. INDEMNITY AND INSURANCE. <br /> <br /> <br />6.01 Indemnity. This Lease is made upon the express condition that Lessee shall indemnify, <br /> <br /> <br />keep and save harmless City, its Council, councilmembers, officers, agents and employees against any and <br /> <br /> <br />all claims, suits, actions, liability, loss, damage, expense, costs (including, without limitation, costs and fees <br /> <br />of litigation) of every nature, kind and description, which may be brought against or suffered or sustained <br /> <br />by City, its Council, councilmembers, officers, boards, commissions, agents, or employees caused by, or <br /> <br />alleged to have been caused by, any act or omission to act of Lessee, its officers, agents or employees, <br /> <br />Lease Agreement-Communications Site - PGE Tower (Redwood Shores Parkway and Radio Road) - Final Rev3 (5/18/07) <br /> <br />8 <br />
