0 R I G I N A L 9/23/96 <br /> <br /> RESOLUTION NO. 12928 <br /> <br /> A RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> APPROVING AND AUTHORIZING EXECUTION OF THE FOURTH <br /> AMENDMENT OF THE DISPOSITION AND DEVELOPMENT AGREEMENT <br /> FOR THEMEZES PLAZA PROJECT <br /> <br /> WHEREAS, the Redevelopment Agency of the City of Redwood <br />City (the "Agency) and Mezes Group, Inc., a California <br />corporation (the "Developer") have negotiated a Fourth <br />Amendment (the "Amendment") to that certain agreement <br />entitled "Disposition and Development Agreement for the Mezes <br />Plaza Project," as amended (the "DDA"); and <br /> <br /> WHEREAS, the City of Redwood City (the "City") is a <br />party to the DDA to the limited extent that the City is to <br />contribute to the Project an easement eight (8') feet in <br />width for underground parking under the portion of Broadway <br />that abuts the Project Site; and <br /> <br /> WHEREAS, this Council has reviewed and considered the <br />Amendment. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE AS <br /> FOLLOWS: <br /> <br /> This Council hereby approves and authorizes the <br /> Mayor and the City Clerk to execute and to attest, <br /> respectively, that certain Amendment entitled "Fourth <br /> Amendment of Disposition and Development Agreement for the <br /> Mezes Plaza Project" on behalf of the City of Redwood City, <br /> such execution to bind the City to the limited extent set <br /> forth in the DDA and the Amendment thereto. <br /> Passed and adopted by City Council of the City of _ ~ <br /> Redwood City, at a regular meeting thereof held on the <br /> day of September, 1996, by the following votes. <br /> <br /> <br />
