6.3A <br /> Page 5 <br /> AN OR�INANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CtTY APPROVENG THE SECOND AMENDMENT OF THE FRANCHISE <br /> AGREEMENT BETWEEN THE C1TY OF REDW�OD CITY AND <br /> ASTOUND, LLC (FORMERLY RCN TELECOM SERVICES, INC) TO <br /> PERMIT ITEMIZATION OF PUBLIC, EDUCATIONAL AND <br /> GOVERNMENTAL {PEG)ACCESS FEES ON SUBSCRIBERS B[LLS <br /> WHEREAS, in Augus# 2000, the City Council of the City of Redwood City, <br /> California ("City"} granted a Cable Television Franchise ("Franchise"} to RCN Telecom <br /> Services of Cafifornia, Inc, which subsequently provided services as RCN Telecom <br /> S�rviees, inc., and <br /> WHEREAS, in September 2004, said Franchise was amended to change the <br /> method by which construction compliance is regulated and to provide for the creation of <br /> a rnul�i-jurisd'r��iar�ai fiber network within Redwood City and neighboring communities; <br /> and <br /> WHEREAS, in January 2007, said Franchise was transferred from RCN Telecom <br /> Services, Inc, to Astound Broadband, LLC; and <br /> WHEREAS, Astound now requests that it be permitted to itemize public, <br /> educational and governrnental (PEG) access fees on its subscribers bilfs; and <br /> WHEREAS, city staff does not believe that such an amenciment will resuit in any <br /> significant adverse impacts ta Redwood City customers. <br /> NOW, THEREFORE THE COUNC(L O� THE CITY OF REDWOOD CITY DQES <br /> HEREBY OR�AlN AS FOLLOW: <br /> 1. That the second amendment to the Franchise, attached as Exhibit A and <br /> incorparated herein by reference, is approved and the City Manager is autharized #o <br /> execute same, <br /> 2.
