With this amertdment,ACA S now oantains strong new protections against the taking of homes,churches and small businesses through eminent domain for transfer to another private party. "We've been working in eamest with my Republican and Democratic colleagues to find a way to protec#cF�urches and piaces o€worship,said Assembfy Member De La 7orre in a news refease issued by Caiifornians for Eminent Dpmain Reform, the coalition backing ACA 8 and ifs companion statutory measure,Assembly Bill(AB)887. "!am hopeful that these amendments bring us ons step Goser to gamering the necessary twa thirds vote in boih houses of the Legislature to present this strong refarm package to the voters in 2J08.,� if FiC��becomes law,as amended,it would: • Prohibit the use of eminent domain to acquire an owner-occupied home(including townhomes, condos and duplexes)for transfer to another private party • Prohibit the use of eminent domain to acquire a church/house af worship ta transfer fa anofher private party. Churches/tiouses of worship are defined as"al!real proper(y used exclusively by the awner#or religious worship if the property qualifies#or tax exemption under the Califomia Constitution for houses af religious warship" • Prohibit govemmenf fran using eminent domain to acguire a smal(business#o transfer to another private party, unless the small business owner is first given the opportunity to participate in the revitalization pfan to eliminate blight • Give#he original owner the right to repurchase a home or smalt business property acquired by eminent domain if the govemment doesn't use tF�e properry for a public use AB 887 info AB 887{De La l'orre)woufd provide enhanced protections for sma11 business owners confronted with eminent damain. Some key provisions of the bill include: • if the small business does not participate in the revitalization pian,it can choose between re4ocating or receiving the value of#he business.
