(c) Naming the City of Redwood City, its Council, officers, boards, commissions,
<br />employees, and agents, as additional insureds; and
<br />(d) Providing that Contractor's insurance coverage will be primary insurance with
<br />respect to City, its Council, officers, boards, commissions, employees, and
<br />agents, and any insurance or self-insurance maintained by City for itself, its
<br />Council, officers, boards, commissions, employees, or agents shall be in
<br />excess of Contractor's insurance and not contributory with it.
<br />16. NON-DISCRIMINATION AND EQUAL OPPORTUNITY. Contractor
<br />warrants and agrees it will not discriminate against any persons seeking services or
<br />employment under this agreement because of their age (except upon the basis of bona
<br />fide occupational qualification, retirement plan or statutory requirement), disability status,
<br />race, color, religion, sex or national origin in the provision of services or extension of
<br />employment opportunities under the Agreement. Contractor further warrants and agrees
<br />that it will comply with relevant local, state and Federal non-discrimination ordinances,
<br />statutes, and regulations pertaining to non-discrimination and equal opportunity, including
<br />but not limited to, Title VI of the Civil Rights Act of 1964 as amended, Title VIII of the Civil
<br />Rights act of 1968 as amended, Section 104(b) and Section 109 of Title 1 of the Housing
<br />and Community Development Act of 1974 as amended, Section 504 of the Rehabilitation
<br />Act of 1973, The Americans with Disabilities Act of 1990, the Age Discrimination Act of
<br />1975, Executive Order 11063, and Executive Order 11246 as amended by Executive
<br />Orders 11375, 11478, and 12086. Contractor will include a statement that it is an equal
<br />opportunity employer in all solicitations or advertisements for subcontractors or
<br />employees.
<br />17. NONDISCRIMINATION IN THE PROVISION OF SERVICES
<br />A. Contractor hereby agrees that it will comply with the provisions of the
<br />American with Disabilities Act (ADA) providing equal access and reasonable
<br />accommodations in employment programs and services to persons who are disabled and,
<br />if applicable, with Section 504 of the Rehabilitation Act of 1973.
<br />B. Contractor hereby agrees that in the provision of services and
<br />Program activities, it will comply with all applicable local, state and federal laws and
<br />regulations prohibiting discrimination and harassment.
<br />18. INTEREST OF PUBLIC OFFICIALS. No covered persons who exercise
<br />any function or responsibility with respect to this Agreement or Contractor's Program
<br />during his or her tenure, or for one year thereafter, will have any interest, direct or indirect,
<br />in this Agreement or a related subcontract, or the proceeds thereof. For purposes of this
<br />paragraph, covered persons include any person who is an employee, agent, consultant,
<br />officer, or elected or appointed official of the City or Contractor. Contractor will incorporate
<br />in all subcontracts hereunder a provision prohibiting such interest.
